Privacy Policy

There are two kinds of people in this policy, and they need different answers. If you have an smskick account, start at section 2. If you received a text and want to know why, skip to section 3.

1. What we do

smskick is software that businesses use to send text messages to their own customers. We run the sending; the businesses choose who to message and what to say. That split runs through everything below.

2. If you have an smskick account

We hold, and use, the following:

  • Your account - email address, business name, and the login links we send you. Used to run your account and to reach you about it.
  • Contacts you upload - phone numbers, names, any custom fields in your CSV, and the consent source and date where you supply them. Held on your behalf, used to send the messages you send.
  • Messages and delivery data - message content, timestamps, delivery status returned by the carrier, and opt-out replies.
  • Drop engagement - when a campaign sends a link to a page we host, we record whether that recipient opened it, whether they asked for a verification code, whether they entered it correctly, whether they saw the page, and which buttons they pressed. Each link is unique to one recipient, so this is tied to their phone number. It exists so the business that messaged them can tell what worked, and so the code can prove the page reached the person who consented rather than whoever the link was forwarded to.
  • Consent records - each time you import a list we store who confirmed it, when, the wording they agreed to, and the IP address it came from. This exists so you can answer a complaint.
  • Billing - handled by Stripe. We store a Stripe customer reference and your credit balance. We never see or store your card number.
  • Usage - server logs, and Google Analytics on our public marketing pages. No advertising or cross-site tracking.

We use all of this to provide the service, bill you, support you, keep the platform from being abused, and meet obligations carriers and regulators put on us. We do not sell it and we do not use your contacts to market anything of our own.

3. If you received a text sent through smskick

We did not choose to message you and we have no relationship with you. A business that uses our software uploaded your number, having told us you agreed to hear from them. They decide who to contact and what to say; we deliver it.

To stop the messages, reply STOP. That is immediate and permanent for that business, and needs nothing else from you. Also fine: "stop", "please stop", "unsubscribe" - we read replies generously on purpose.

To find out what a business holds about you, or to have it deleted, ask that business - it is their record, and we cannot change or delete it on their behalf. If you cannot identify who texted you, or you believe you never agreed to it, write to abuse@smskick.com with the message and the number it came from. We investigate those, and a business that cannot show consent loses its account.

4. Who else sees it

  • Messaging carriers and providers - the recipient's number and the message, because that is what delivering a text means.
  • Stripe - payment processing.
  • Resend - the emails we send you about your account.
  • Google Analytics - public marketing pages only, not the app.
  • Our hosting provider - infrastructure the service runs on.
  • Carriers, regulators or law enforcement - where we are required to respond, or where a complaint is being investigated.

That is the complete list. We do not sell personal information, and we do not share it for anyone else's advertising.

5. How long we keep it

Account and contact data lasts while your account is open. Close it and we delete your contacts and message history.

Two things outlive the account: suppression records, because a number that opted out must stay opted out even if the list is re-uploaded later; and consent attestations, because they are the evidence that the messaging was permitted and deleting them on request would defeat the point of keeping them.

6. Your choices

Account holders can export contacts and message history at any time, and can ask us to delete the account and its data at support@smskick.com. Depending on where you live you may have rights to access, correct, or object to how your data is used; write to the same address and we will honour them.

Cookies: a signed session cookie to keep you logged in, and Google Analytics on the marketing pages. Nothing that follows you around the web.

7. Security, location, and age

Data is encrypted in transit, access is limited to people who need it to run the service, and API keys are shown once and stored hashed. No system is perfectly secure, and we would rather say that than imply otherwise.

The service is operated from the United States and data is stored there. smskick is for businesses, and is not intended for anyone under 18.

8. Changes and contact
